These Terms & Conditions (“Terms”) govern use of tiyaaura.com and purchases made from TYA & Co Pty Ltd (ABN 66 687 255 125), trading as Tiya Aura (“Tiya Aura”, “we”, “us” or “our”). By using the Site or placing an order, you agree to these Terms and the policies linked on the Site. If you do not agree, do not use the Site.

1. Eligibility And Acceptable Use

You must be at least the age of majority in your province or territory, or use the Site with the involvement of a parent or guardian. You may not use the Site for unlawful, fraudulent, abusive or harmful activity; interfere with security; introduce malicious code; scrape the Site contrary to law; or infringe the rights of others.

2. Products And Information

We aim to describe products accurately, including materials, colour, dimensions and care instructions. Screen settings and lighting can affect colour appearance, and handmade or textile items may have minor variations. Measurements are approximate unless stated otherwise. Read the product page and care label before use or washing.

3. Prices, Currency And Taxes

Prices are displayed in Canadian dollars when Canada is selected as your market. Applicable taxes, delivery charges, discounts and any other mandatory charge collected by us are disclosed before you submit payment. Prices and promotions may change, but a change does not affect an order already accepted. A comparison or “regular” price is used only where we have a reasonable basis and records supporting the claim.

4. Orders And Contract Formation

Your order is an offer to purchase. An automated acknowledgement confirms receipt, not acceptance. We accept the order when we send a shipping confirmation or otherwise expressly confirm acceptance. We may refuse or cancel an order before acceptance for reasons such as unavailable stock, payment failure, suspected fraud, delivery restrictions or an obvious pricing error. If payment was taken for a cancelled order, it will be refunded.

5. Payment

You must provide current and accurate billing information and be authorized to use the selected payment method. Payments are processed by third-party providers under their terms and privacy policies. We do not receive your complete payment-card number.

6. Delivery

Processing times, delivery estimates, tracking, fulfilment locations, charges and delay procedures are explained in our Shipping Policy. Delivery dates are estimates unless we expressly agree otherwise. Risk of loss passes as provided by applicable law.

7. Returns, Refunds And Consumer Rights

Our 30-Day Comfort Guarantee includes at-home trials and change of mind. Approved refunds or replacements do not require return shipping, as described in our Refund & Return Policy. Nothing in these Terms excludes, restricts or modifies a warranty, condition, right or remedy that cannot lawfully be excluded under applicable Canadian federal, provincial or territorial law.

8. Limited Product Warranty

Where a product page states a five-year limited warranty, it applies to eligible manufacturing defects for the period stated, subject to the separate warranty terms. It does not cover ordinary wear, accidental damage, misuse, improper care, alteration or normal changes in appearance. Mandatory consumer rights continue to apply.

9. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly if you suspect unauthorized use. We may suspend an account to protect the customer, the Store or others.

10. Reviews And User Content

If you submit a review, photograph or other content, you confirm it is truthful, based on your genuine experience, and does not infringe another person’s rights. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display the content for operating and promoting Tiya Aura, subject to applicable privacy and advertising law. We may moderate unlawful, irrelevant, deceptive or abusive content but will not alter the substance of a genuine review.

11. Promotions And Marketing

Promotions are subject to their stated dates, eligibility and availability and cannot be combined unless stated. Marketing messages are sent in accordance with applicable law. You may unsubscribe at any time using the instructions in the message.

12. Intellectual Property

The Site and its text, graphics, branding, photographs, videos, code and layout are owned by or licensed to us and protected by intellectual-property laws. You may use the Site for personal, non-commercial shopping. No other use is permitted without written authorization.

13. Third-Party Services And Links

The Site may use or link to services operated by Shopify, payment providers, carriers, social networks and other third parties. Their services are governed by their own terms. We are not responsible for third-party sites or services except to the extent required by law.

14. Disclaimer And Limitation Of Liability

To the maximum extent permitted by law, the Site is provided on an “as available” basis and we do not guarantee uninterrupted or error-free access. We are not liable for indirect, incidental, special or consequential loss that was not reasonably foreseeable. Our liability is not excluded or limited where doing so would be unlawful, including liability for fraud, wilful misconduct, or rights and remedies that consumer law makes mandatory.

15. Indemnity

To the extent permitted by law, you agree to indemnify us against third-party claims caused by your unlawful misuse of the Site, infringement of another person’s rights or material breach of these Terms. This section does not apply to losses caused by our own negligence or misconduct.

16. Privacy

Our Privacy Policy explains how we collect, use, disclose and protect personal information and how to exercise privacy rights.

17. Changes And Availability

We may update the Site, products or these Terms. The version in effect when your order is accepted applies to that order unless a change is required by law or you agree otherwise. If a provision is unenforceable, the remaining provisions continue in effect.

18. Governing Law And Disputes

These Terms are governed by the laws that apply to the transaction, including applicable laws of Canada and the province or territory where the customer resides. Nothing in these Terms prevents a consumer from using a court, tribunal or consumer-protection process available under mandatory law.
